Terms are subject to change without notice. The construction, interpretation and performance of orders shall be governed by and construed in accordance with the laws of England regard to its conflict of law rules.
Please note that Digital Cushions is a wholesale website. We deal with trade customers only.
In order for us to deal with your enquiries more efficiently, please quote your account number in all correspondence and when contacting us via the telephone, email or online chat. Your personal information will never be shared with any third party companies in any way, with the exception of our nominated couriers.
Orders
Our system sends an automatic email confirmation after an order has been submitted via the website. This email is NOT the final invoice.
As our shopping cart does not calculate any discounts or special offers, these are added to your order in the processing stage and will be visible in your account
on-line, once the order is processed. You will receive your final invoice with your delivery.
Carriage
Carriage is free for orders over £175 before VAT and after discounts (UK mainland), otherwise charge of £7.50+VAT is made.
For Scottish Highlands, British Isles and Northern Ireland, for orders below £495 before vat, the carriage charge is £15+VAT.

Out Of Stock Items
We try to keep our website as up-to-date as possible. If an item becomes unavailable after an order has been placed, we do not charge for this item. Such item is marked in the 'out of stock' column on the final invoice and its price is deducted from the overall total of the order, before the card payment is taken.
PayPal: Any differences (due to discounts or unavailability of an item) are refunded back to your PayPal account. BACS/ Cheque: Any differences in payment will be noted as credits to be used against next order.
Please note we do not offer a back-order service.
Payment
We accept payments by credit or debit cards, PayPal, cheques or BACS. Oh-So-Soft retains ownership of all goods until payment is received in full.
Prices
All prices quoted are net of VAT. We make every effort to keep the prices on our website up to date, however any changes to said prices are subject to change without notice. The prices on the website supersede any other sources.
Replacement / Credit
Credit against next order, rather than a replacement is given for breakages or items omitted from your order. Please note that all breakages or shortages must be reported within 2 working days from delivery of your order.
Please be aware that we do not, as a rule, post credit notes out. A note is made against your record and this will be applied against your next order.
Returns
If you change your mind, order an incorrect item or order too many items, you may return the items, provided that their packaging is intact and in a saleable condition. The items must be returned within 7 days from the delivery of your order and at your own cost. A refund for goods will be issued. Please note we do not accept returns of personalized goods (e.g. mugs or earrings).
Cancelled orders
Orders cancelled after despatching will be subject to charges incurred (carriage charge will not be credited or refunded - £7.50+VAT or £15+VAT.)

Special Orders
Digital Cushions reserves the right to request a deposit or a payment in full for any special orders made.

a) This agreement shall be governed by and interpreted in accordance with English Law and the parties hereby submit to the jurisdiction of the English Courts.
b) Implied terms shall be executed to the fullest extent permitted by law.
c) If either party is affected by 'Force Majeure' (material circumstances beyond reasonable control of that party) it shall immediately notify the other party in full of the nature and extent of the circumstances. Notwithstanding the other provisions of this agreement neither party shall be deemed to be in breach of this agreement or liable as a result of the Force Majeure. Where Digital Cushions has claimed Force Majeure in respect of the supply of goods or services, the Customer may choose to obtain support services from another party.
d) Any director or representative of the Customer will be deemed to be its authorized signatory and thereby guarantee the Customer's acceptance of its obligations under this agreement.
e) Failure of either party to exercise or enforce any right within this agreement shall not be deemed to be a waiver of such right.
